Beach Houses Valencia acts as an authorised management company, marketing company or intermediary for tourist and/or temporary accommodation. In certain accommodations, ownership of the property belongs to a third-party owner, with Beach Houses Valencia acting as the company authorised to manage the booking, commercialisation, guest assistance, payment collection, check-in and check-out coordination, support during the stay and other related services.
In order to formalise a booking, the guest must read and accept these general conditions.
2. Nature of the stay
The booking is of a tourist, holiday or temporary nature, intended for a short stay, rest, leisure, family reasons, professional reasons or similar purposes.
The booking shall not be considered a residential lease and shall not give the guest the right to use the accommodation as a permanent residence, habitual residence, tax address, registered office, place of census registration or any other use different from the one contracted.
The guest acknowledges that the stay has a temporary purpose and undertakes to leave the accommodation on the agreed date and time.
3. Tourist registration and registration number
The accommodations marketed by Beach Houses Valencia shall have, when legally required, the corresponding regional tourist registration number, tourist licence, short-term rental registration number, NRA or any other applicable administrative identification.
These numbers may appear in the accommodation listing, booking confirmation, website, marketing platform or documentation provided to the guest.
The booking shall be subject to the accommodation being legally available for commercialisation on the contracted dates. If, for administrative, registry, urban planning, community, technical or force majeure reasons, it is not possible to maintain the booking, Beach Houses Valencia will try, whenever possible, to offer alternative accommodation of similar characteristics or the corresponding refund in accordance with these conditions.
4. Accommodation information, photographs and descriptions
Beach Houses Valencia makes every effort to ensure that the information, photographs, equipment, location, services and characteristics of each accommodation are as accurate and up to date as possible.
However, photographs, plans, measurements, decoration, furniture, layout, views, equipment or decorative elements may present minor variations from the actual condition of the accommodation at the time of the stay. These minor differences shall not automatically entitle the guest to cancellation, compensation or refund, provided that they do not substantially alter the nature, capacity, location or essential conditions of the accommodation.
Owners may make changes to furniture, decoration, appliances, layout or accessories. Beach Houses Valencia will try to update the information on the website when it becomes aware of such changes and, when they are relevant, will inform the guest before arrival.
5. Prices, availability and booking confirmation
The prices published on the website are indicative until the booking has been definitively confirmed. Rates may vary depending on season, occupancy, length of stay, demand, special dates, availability, sales channel, promotions or any other commercial criteria.
The booking shall be confirmed once Beach Houses Valencia has received the corresponding initial payment and has sent the guest an express confirmation by email, WhatsApp or any other written means.
The reference currency shall be the euro (€). Any conversion into another currency shall be for information purposes only.
6. Payments
To formalise the booking, the guest must pay the amount indicated during the booking process. Unless otherwise stated in the accommodation listing or booking confirmation, an initial payment of 10% of the total booking amount will be requested.
The remaining balance must be paid no later than 7 days before the check-in date, unless another payment method has been expressly agreed.
If the outstanding balance is not paid within the indicated period, Beach Houses Valencia may cancel the booking, applying the corresponding cancellation policy.
The available payment methods shall be those indicated on the website, during the booking process or in the communications sent by Beach Houses Valencia. These may include bank card, bank transfer, payment link, online payment or other authorised methods.
Beach Houses Valencia shall not be responsible for commissions, bank charges, exchange rate differences or charges applied by the bank, card issuer or payment provider used by the guest.
7. Cancellation policy
Cancellations must always be communicated in writing to Beach Houses Valencia by email, WhatsApp or the method indicated in the booking confirmation.
Unless a different policy is stated in the accommodation listing, promotion, platform or booking confirmation, the following general policy shall apply:
Cancellation 15 days or more before arrival:
The guest shall be entitled to a refund of the amounts paid, except for bank charges, non-recoverable management costs or special conditions indicated in the booking.
Cancellation less than 15 days before arrival:
The initial payment of 10% shall not be refundable. If the guest has paid additional amounts, the amounts to be refunded will depend on the specific case and cancellation date.
Cancellation less than 7 days before arrival:
There shall be no right to a refund of the booking amount.
No-show:
If the guest does not arrive on the scheduled check-in date, the booking shall be considered cancelled and shall not entitle the guest to any refund.
Early departure:
Voluntary early departure by the guest shall not entitle the guest to a refund for unused nights.
When the booking has been made through an external platform such as Booking.com, Airbnb, Expedia or another similar platform, the cancellation policy indicated on that platform shall apply, unless Beach Houses Valencia has expressly agreed otherwise in writing.
8. Right of withdrawal
As this is an accommodation booking for specific dates or periods, the general 14-day right of withdrawal applicable to certain distance contracts does not apply.
Therefore, if the guest wishes to cancel the booking, the cancellation policy accepted at the time of booking shall apply.
9. Changes to dates, accommodation or booking holder
Any change to dates, accommodation, length of stay, number of guests or booking conditions shall be subject to availability and must be authorised by Beach Houses Valencia.
The change may involve a price difference, supplement or management fee.
The booking is personal and non-transferable. The guest who holds the booking may not transfer it to third parties without the prior written authorisation of Beach Houses Valencia.
10. Alternative accommodation or impossibility of providing the service
If, before arrival or during the stay, the booked accommodation becomes unusable or cannot be occupied due to a serious cause, breakdown, technical incident, administrative issue, force majeure, decision of the owners’ community, emergency or any cause not directly attributable to the guest, Beach Houses Valencia will try to offer alternative accommodation of similar characteristics.
If the alternative accommodation has a higher price, the guest may accept the change by paying the difference, unless Beach Houses Valencia decides to cover it fully or partially.
If it is not possible to offer suitable alternative accommodation, the guest shall be entitled to a refund of the amounts corresponding to the accommodation not enjoyed.
In such cases, the liability of Beach Houses Valencia shall be limited to the amount actually paid by the guest for the unused nights, unless otherwise legally required.
11. Mandatory traveller registration
The guest must provide, before entry or during check-in, all personal data and documentation required to comply with the legal obligations of documentary registration and communication to the competent authorities.
Every person over the age of 14 must sign the corresponding entry form. In the case of children under 14, the data shall be provided by the responsible adult.
Failure to provide the mandatory data, the provision of false, incomplete or inaccurate data, or the impossibility of verifying the identity of the guests may legally prevent the handover of keys or the continuation of the stay, without this automatically generating the right to a refund.
The guest who holds the booking shall be responsible for ensuring that all persons staying in the accommodation correctly provide their details.
12. Data protection
The personal data provided by the guest shall be processed by Beach Houses Valencia for the management of the booking, provision of the service, communication with the guest, invoicing, handling of incidents and compliance with legal obligations.
Certain data must be communicated to the competent authorities in compliance with traveller registration regulations.
The guest may consult additional information on the processing of their personal data in the Privacy Policy published on the Beach Houses Valencia website.
13. Number of guests and maximum occupancy
The accommodation may only be occupied by the persons included in the booking and registered during check-in.
For safety, regulatory and coexistence reasons, the maximum authorised capacity of the accommodation may not be exceeded.
Unregistered persons may not stay overnight in the property or use its facilities, common areas, swimming pool, garage, storage room, terrace, gardens or associated services without prior authorisation from Beach Houses Valencia.
Breach of this condition may, in serious cases, result in the cancellation of the stay and/or the charging of the corresponding amounts for damages, misuse, penalties or breach of community rules.
14. Minors
Minors must always stay accompanied by a responsible adult.
The adult who holds the booking shall be responsible for the behaviour, safety, damages, use of facilities and compliance with rules by the minors staying in the accommodation.
Bookings made exclusively by minors will not be accepted.
15. Community rules and coexistence
The guest undertakes to respect the rules of the owners’ community, building or residential complex where the accommodation is located.
This includes, among others, rules relating to noise, rest hours, use of lifts, garages, swimming pools, gardens, terraces, sports areas, entrances, corridors, rubbish collection and other common elements.
The guest must behave respectfully towards neighbours, maintenance staff, caretakers, cleaning services and any other person connected with the accommodation or community.
Justified complaints from neighbours, police intervention, reports, penalties, repeated disturbances or serious breach of coexistence rules may result in the termination of the stay without the right to a refund, as well as a claim for damages, penalties or costs caused.
16. Swimming pools, gardens and common areas
The use of swimming pools, gardens, sports areas, garages, lifts, communal terraces and other common areas shall be subject to the rules, schedules, opening seasons, capacity limits, restrictions and decisions of the owners’ community, property administrator or maintenance company.
Beach Houses Valencia shall not be responsible for temporary closures, usage restrictions, maintenance incidents, changes in opening hours, capacity limitations or decisions adopted by the owners’ community.
The guest must especially respect safety rules in swimming pools and common areas. Minors must always be supervised by a responsible adult.
17. Parties, events and noise
To ensure neighbours’ rest and good coexistence in the building or residential complex, parties, events, celebrations, stag or hen parties, large gatherings or any activity that may disturb neighbours or third parties are not permitted, unless expressly authorised in writing by Beach Houses Valencia.
Rest hours between 10:00 p.m. and 9:00 a.m. must be especially respected, without prejudice to stricter rules that may be established by the owners’ community or municipal regulations.
The use of speakers, sound systems, televisions, musical instruments or any other device at a volume that may disturb neighbours is not permitted.
Breach of this clause may, in serious or repeated cases, result in the termination of the stay, total or partial loss of the deposit and a claim for damages, penalties or costs caused.
18. Pets
Pets are only allowed when expressly stated in the accommodation listing or when Beach Houses Valencia has previously authorised them in writing.
If authorised, the guest shall be responsible for any damage, dirt, odour, noise, disturbance to neighbours, extraordinary cleaning or incident caused by the pet.
Bringing animals without authorisation may result in additional charges and, in serious cases, cancellation of the stay.
19. Smoking prohibition
Unless expressly authorised in the accommodation listing, smoking is not allowed inside the property.
In the event of persistent tobacco smell, ashes, burns, cigarette ends, damage to furniture or textiles, or the need for special cleaning or deodorising, the corresponding costs may be charged to the guest.
On terraces or outdoor areas, if smoking is allowed, ashtrays must be used and any disturbance to neighbours or fire risk must be avoided.
20. Responsible use of the accommodation
The guest undertakes to make responsible use of the accommodation, furniture, appliances, air conditioning, awnings, blinds, windows, doors, locks, terrace, kitchenware, bed linen, towels and other elements.
For safety reasons, it is not permitted to manipulate electrical, water, gas, air conditioning, telecommunications, lock, fuse box, boiler, water heater, antenna, router or any other technical installation of the accommodation.
It is also not permitted to move heavy furniture, take indoor furniture outside, hang objects from railings, use unauthorised barbecues, use candles dangerously, overload sockets or carry out any activity that may cause damage, disturbance or risk.
21. Awnings, blinds, terraces and weather conditions
The guest must make prudent use of awnings, parasols, blinds, outdoor furniture and terrace elements.
In the event of wind, rain, storm, absence from the accommodation or during the night, awnings, parasols and movable elements must be folded away and secured.
Damage caused by improper use, negligence, wind, rain or failure to fold away awnings, parasols or outdoor furniture may be charged to the guest when there is negligence or breach of the instructions provided.
22. Use of utilities
The guest must make reasonable use of electricity, water, gas, air conditioning and internet.
It is recommended not to leave air conditioning or heating running with doors or windows open, nor to leave lights, appliances or climate control systems on unnecessarily when leaving the property.
The charging of electric vehicles, scooters, electric bicycles, external batteries or other high-consumption devices is only permitted if the accommodation expressly authorises it and under safe conditions.
Clearly abusive, negligent use or use contrary to the instructions provided may result in additional charges.
23. Internet and technological services
When the accommodation has an internet connection, it is offered as an additional service.
Beach Houses Valencia cannot guarantee minimum speed, permanent availability or suitability for professional activities, remote working, video calls, streaming, gaming or other intensive uses, unless expressly stated in writing.
Interruptions, operator faults, network failures, power cuts, signal saturation, coverage problems or incidents beyond the control of Beach Houses Valencia shall not automatically entitle the guest to compensation.
However, Beach Houses Valencia will try to manage any incident with the greatest possible diligence.
24. Check-in and arrival
The ordinary check-in time shall be the one indicated in the accommodation listing or booking confirmation.
The guest must communicate their approximate arrival time sufficiently in advance and notify the person in charge of check-in following the instructions sent.
Arrivals outside the usual schedule shall be subject to availability and may involve a supplement if previously communicated.
Beach Houses Valencia shall not be responsible for delays in the handover of keys caused by lack of communication from the guest, arrival outside the agreed schedule, incomplete documentation, unpaid amounts or failure to complete the mandatory traveller registration.
25. Check-out and departure
Unless another time is indicated in the accommodation listing or booking confirmation, check-out must take place before 11:00 a.m.
The guest must leave the accommodation reasonably tidy, remove rubbish, wash or collect used dishes, switch off lights, air conditioning and appliances, close windows and doors, and return keys, remote controls or access cards according to the instructions provided.
Unauthorised late check-out may generate additional charges, especially if it delays cleaning, inspection of the accommodation or the arrival of the next guests.
26. Cleaning
The accommodation shall be delivered clean and prepared for the stay.
Ordinary final cleaning does not include removal of accumulated rubbish, unwashed dishes, food remains, extraordinary stains, excessive dirt, cigarette ends, vomit, disproportionate accumulation of sand, bad odours, improper use of bed linen or towels, or any situation requiring special cleaning.
In such cases, Beach Houses Valencia may charge the guest the additional costs of cleaning, laundry, replacement, disinfection or repair.
27. Bed linen, towels and kitchenware
The guest must make proper use of bed linen, towels, kitchenware, cooking utensils and other items made available to them.
It is not permitted to use bath towels as cleaning cloths, beach mats, protection for hair dye, make-up, chemical products or any use other than the usual one.
Loss, breakage, permanent stains or abnormal deterioration of textiles, kitchenware or equipment may be charged to the guest.
28. Keys, remote controls and access to the accommodation
The guest shall be responsible for keys, cards, garage remote controls, access devices or any other item handed over during the stay.
For safety reasons, it is not permitted to make copies of keys, provide access to unregistered persons or modify any locking system.
Loss, breakage, failure to return, leaving keys inside the property, extraordinary call-outs to open the door or locksmith intervention may be charged to the guest.
If, for security reasons, it is necessary to replace the lock, cylinder, remote control or access system, the cost may be charged to the responsible guest.
29. Deposit or guarantee pre-authorisation
Beach Houses Valencia may request a deposit or carry out a card pre-authorisation before arrival, during check-in or in the days prior to arrival.
The amount may vary depending on the accommodation and will be indicated in the booking listing, specific conditions or communication prior to check-in.
The deposit shall cover, among other things, damage to the property, loss of keys or remote controls, extraordinary cleaning, misuse of facilities, breach of check-out times, penalties arising from the guest’s conduct, replacement of damaged or missing items and any other loss attributable to the guest.
The refund or release of the pre-authorisation shall take place once the accommodation has been inspected after departure. The effective release period may also depend on the guest’s card-issuing bank.
30. Breakdowns, incidents and maintenance
The guest must inform Beach Houses Valencia of any breakdown, damage, leak, malfunction, breakage or incident detected during the stay.
Beach Houses Valencia will try to resolve incidents as quickly as possible, taking into account the availability of technicians, suppliers, parts, owners’ community or external services.
The guest should not arrange repairs on their own or manipulate installations without prior authorisation from Beach Houses Valencia, except in a justified emergency situation.
31. Access to the accommodation during the stay
Beach Houses Valencia may access the accommodation, giving prior notice to the guest whenever possible, to carry out repairs, inspections, maintenance, necessary checks, replacement of items, handling of incidents or justified inspections.
In the event of an emergency, risk to the property, neighbours, utilities, safety or installations, access may be carried out without prior authorisation from the guest.
32. Works, external noise and circumstances beyond our control
Beach Houses Valencia shall not be responsible for noise, works, supply cuts, traffic restrictions, municipal events, local festivities, actions by owners’ communities, works in neighbouring buildings, incidents on beaches, weather phenomena, occasional pests, smells, smoke, noise from neighbours or other external circumstances that do not directly depend on its actions.
However, when Beach Houses Valencia has prior knowledge of a relevant incident that may substantially affect the stay, it will try to inform the guest within a reasonable time and seek a proportionate solution.
33. Force majeure
Beach Houses Valencia shall not be responsible for breaches, delays, cancellations, damages or inconvenience arising from force majeure or circumstances beyond its control.
Force majeure shall include, among others, extreme weather phenomena, fires, floods, administrative restrictions, pandemics, health emergencies, general supply cuts, strikes, disturbances, terrorist acts, decisions by public authorities, structural damage, evacuation orders or any other unforeseeable or unavoidable circumstance.
34. Personal belongings
The guest shall be responsible for their belongings, money, documentation, electronic devices, jewellery, vehicles and other personal items during the stay.
Beach Houses Valencia shall not be liable for loss, theft, misplacement or forgotten belongings, except in cases where direct responsibility is proven.
If forgotten items are found, Beach Houses Valencia will try to contact the guest. Shipping, courier service or special storage of such items shall be at the guest’s expense.
35. Vehicles, garages and parking
When the accommodation includes a garage space, communal parking or parking area, its use shall be subject to availability, dimensions, community rules and the conditions indicated in the accommodation listing.
The guest shall be responsible for checking that their vehicle can access and park correctly in the assigned space or area.
Beach Houses Valencia shall not be responsible for damage, theft, dents, penalties, towing, traffic restrictions or incidents related to vehicles, except where direct responsibility is proven.
36. Conduct not permitted
To ensure a pleasant stay and good coexistence with neighbours and communities, the following conduct is not permitted:
- Exceeding the maximum authorised number of guests.
- Accommodating or allowing entry to unregistered persons.
- Holding unauthorised parties, events or gatherings.
- Causing disturbance to neighbours or third parties.
- Bringing pets without authorisation.
- Smoking inside if not permitted.
- Manipulating technical installations.
- Carrying out dangerous, illegal activities or activities contrary to peaceful coexistence.
- Damaging furniture, appliances, textiles, locks or common areas.
- Breaching community, swimming pool, garage or building rules.
- Using the accommodation for purposes other than those contracted.
Serious breach of these rules may result in termination of the stay without the right to a refund, without prejudice to any claim for damages, expenses, penalties or losses caused.
37. Complaints and incidents during the stay
Any incident must be communicated to Beach Houses Valencia as soon as it is detected, during the stay, so that it can be checked and, where appropriate, resolved.
The guest must allow Beach Houses Valencia a reasonable period to verify and resolve the incident.
Failure to communicate an incident immediately during the stay may limit or prevent a later claim if such lack of notice has prevented the problem from being checked or corrective measures from being taken.
Complaints must be submitted in writing to the email address indicated by Beach Houses Valencia, including a description of the facts, photographs, videos or any other supporting documentation.
38. Official complaint forms
Beach Houses Valencia has official complaint forms available to consumers and users, in accordance with the applicable regulations.
Requesting an official complaint form does not prevent both parties from trying to resolve the incident amicably beforehand.
39. Limitation of liability
Beach Houses Valencia shall not be responsible for damages, injuries, accidents, losses or harm arising from improper use of the accommodation, breach of rules, negligent conduct by the guest, misuse of facilities, alcohol or substance use, lack of supervision of minors, imprudence in swimming pools or common areas, or circumstances beyond the company’s control.
The liability of Beach Houses Valencia, where legally applicable, shall be limited to the amount actually paid by the guest for the affected booking, except in cases where applicable regulations provide otherwise.
Nothing in these conditions shall limit the rights that correspond to the guest as a consumer when such rights are mandatory and cannot be waived.
40. Communications
Communications between Beach Houses Valencia and the guest may be made by email, telephone, WhatsApp, SMS, booking platform or any other written means provided by the guest.
The guest shall be responsible for providing correct contact details and for checking the communications sent by Beach Houses Valencia before and during the stay.
41. Bookings made through external platforms
When the booking is made through an external platform such as Booking.com, Airbnb, Expedia, Vrbo or another similar platform, the conditions, cancellation policy, payments, rules and procedures of that platform may additionally apply.
In the event of contradiction between these general conditions and the specific conditions accepted on the platform, the particular conditions of the booking shall prevail where applicable.
42. Not considered a package travel service
The accommodation booking made with Beach Houses Valencia does not, by itself, constitute a package travel service.
Tourist information, recommendations, local guides, links, restaurant suggestions, activity suggestions, beaches, transport or external services that may be provided to the guest shall be for information purposes only.
Beach Houses Valencia shall not be responsible for the provision, availability, quality, price, safety or conditions of services offered by third parties outside the company.
43. Mediation and dispute resolution
The parties shall try to resolve amicably any disagreement related to the booking or stay.
Where both parties accept it, they may resort to mediation or out-of-court dispute resolution mechanisms.
If no agreement is reached, jurisdiction shall be determined in accordance with the applicable regulations on consumers and users.
44. Applicable law
These conditions shall be governed by Spanish law and, where applicable, by tourist, civil, commercial, consumer and user, data protection, electronic commerce and other current regulations.
45. Acceptance of the conditions
By making a booking, paying any amount, ticking the acceptance box, signing the entry form, accessing the accommodation or enjoying the stay, the guest declares that they have read, understood and accepted these general conditions.
The guest who holds the booking accepts these conditions on their own behalf and on behalf of the other persons included in the booking, undertaking to inform them of their content and to be responsible for their compliance.
